In further consideration of any use of The BackGuide_TM, the user further agrees to indemnify and hold harmless the University of Calgary, the Institute for Work & Health and each of their employees, officers, directors, agents and staff members from any and all loss, cost, damage, expense, claims, proceedings actions or causes of action, taken or continued by any patient or in respect of any such patient, directly again any, some or all of the persons the user has hereby agreed to indemnify and hold harmless, or against any person who takes any action or proceeding against any, some, or all of the persons the user has hereby agreed to indemnify and hold them for contribution, indemnity, or reimbursement, whether under the provisions of any statute, regulation, common law, or Quebec Civil code.

In no circumstance will the University of Calgary, the Institute for Work & Health, or any of their officers, directors, employees, agents and staff be responsible or liable in any way for any diagnosis or other decision made by the user of The BackGuide_TM, whether or not the user has used or relied upon any information or other data supplied or generated in or by The BackGuide_TM, or omitted to be supplied or generated by The BackGuide_TM, nor will they or any of them have any obligation or liability for damages or otherwise, however incurred, by anyone, including but not limited to, special, general and indirect or consequential damages arising out of or in connection with the use or performance of The BackGuide_TM, including without limiting the generality of the foregoing, anything contained in or omitted to be contained in The BackGuide_TM.
